Family Code Revision Confirms Morocco as 'Regional Leader' in Legal Modernization, Says Spanish Scholar

The revision of the Family Code responds to one of the major priorities set by HM King Mohammed VI since his ascension to the throne, consolidating women’s rights and ensuring better protection of children’s rights, Klein told MAP.

This project continues the fundamental reforms initiated at the Sovereign’s accession to the throne, marking a decisive step in the country’s social modernization, he noted.

“The efforts made in infrastructure development and services across all regions of Morocco find their extension in this social reform, which places the family at the heart of national priorities.”

According to the scholar, Morocco, through this reform, is now positioning itself as a “leader and an example to follow” by showing that it is possible to progress toward gradual modernization while preserving the authenticity of its civilization.

This reform, which prioritizes equality between men and women in accordance with the Constitution and Morocco’s international commitments, reflects a significant evolution in Moroccan family law, resulting from broad consensus on the central role of women and youth in driving change, he stressed.

He also pointed out that “women have long played a fundamental role in social transformations, while young people aspire to more open models that are connected to global dynamics.”

Klein also praised the approach adopted to carry out this reform, expressing satisfaction with the fact that it is based on national dialogue involving various sectors of society, ensuring that the Family Code perfectly reflects the expectations and needs of all.

The Spanish scholar further highlighted Morocco’s efforts to align its legal framework with international human rights standards while preserving the country’s religious and cultural specifics.
